Intelligent Terminal Product Warranty Policy

I. Introduction

H3C intelligent terminal hardware products are generally covered by a one (1) year or three (3) years warranty. For detail information about corresponding product, please read the table-1.

Notes:

1、The warranty information in this Warranty Policy is H3C general warranty policies. In specific countries and regions, the warranty service and service SLA may be different with local adjustment, if there’s any difference between this Warranty Policy and local laws and regulations, the local laws and regulations shall prevail, please consult your local sales representatives for more details.

2、The warranty shall be provided by H3C or the H3C authorized Channel Partner (collectively referred to in this document as “H3C”). H3C warranties are subject to and provided only on the terms and conditions depict in this document. If there is any conflict with contract terms and conditions, the contract terms and conditions shall prevail.

II. General terms and conditions

1、Hardware Warranty Period: For the Run Rate business products, the products warranty (“Hardware Warranty Period”) starting from the date of sale to the end-user or from 180 days after the date of shipping to Partner, the earlier date shall prevail (“Starting Date of Hardware Warranty Period”). In any case, Partner shall warrant that its Customers can have same hardware warranty period from the date that Customers or end users purchase the Product from Partner.

2、H3C warrants for software and hardware for a period of certain days from the Starting Date.

3、During the warranty period, if the hardware has material and process problems in accordance with the normal authorized use of the product description, resulting in the end user's need for hardware fault repair and replacement, the replaced hardware can be new equipment or spare parts of the same type, function and quality. The replacement rules are as follows:

(i)You can contact the purchase channel to confirm the fault and replace it, Or contact the official after-sales service via email Support.Magic@h3c.com for fault confirmation and replacement.

(ii)Spare parts delivery description: If you buy a router, switch, AC/AP products, Spare parts are shipped from the local country. If you buy a cloud screen product, then the spare parts may be shipped from the local country, or it may be sent from China. if you want accurate information, it is recommended to contact the local sales manager.

(iii)The cost of sending back the faulty parts involved in the repair process needs to be borne by the customer.

4、The warranty period of product will not be influenced due to resale or repair. But the warranty period for the replacement or the repaired unit is three months or the remainder of the initial warranty period both starting from the delivery of the replacement or the repaired unit by H3C, whichever is longer.

5、Dead On Arrival (DOA). Within thirty (30) days from the Starting Date, H3C will provide expedited replacement of hardware that has no appearance damage upon unpacking but fails to operate within forty-eight (48) hours of initial installation. “Fail to operate” shall mean a material failure to substantially perform in accordance with the hardware’s technical specifications (excluding exterior nick or other deficiencies that do not materially affect hardware performance). H3C will ship a new replacement unit or part of H3C’s confirmation of DOA failure and commercial reasonable solution. Actual delivery times should allow for additional transit time due to transportation reasons.

Notes:

1. 5*9: Available nine hours a day(9 a.m-6 p.m), five days a week, excluding local official holidays.

2. 10BD-S: Replacement hardware will be shipped within 10 business days. For RMA issued after 15:00 (3 p.m.) local time will be considered as issued on the next business day.

3. Hardware replacement support service have countries and mode of transportation constraints, specific restrictions please consult your local sales representatives.

IV. Limitation of Liability

(i)No warranty will apply if the hardware or software (a) has been repaired or replaced, without H3C’s permission; (b) has not been installed or operated in accordance with instructions released by H3C in the enclosed documentation; (c) has been subject to unreasonable physical impact, contamination, fire, lightning, flood, misuse, abuse or disaster; or (d) degaussing, pollution or other external causes.

(ii)The product is not from H3C or cannot be proven to be from H3C.

(iii)Labels such as product serial number (SN) label, tamper-evident label, MAC address label, etc. are torn or damaged or forged.

(iv)The antenna breakage or damage of wireless products is not caused by material or production quality.

(v)Abnormal damage such as appearance damage, abnormality, accidental damage, wear, equipment corrosion, and external power supply damage, etc.

(vi)Using a non-H3C original bracket, or installation or modification or repair of the device by oneself without H3C's permission.

(vii)Losses caused by the use of software or systems not authorized by H3C, including but not limited to the failure or loss resulting from virus infection, hacker attacks or other malicious acts.

(viii) Damage caused by removal or alteration by people other than an H3C-authorized repairer.

Product damage caused by failure to use, maintain and store in accordance with the requirements of the product instruction manual.

(ix)H3C will not provide guarantee for customer data stored in the product or related to the product by other means. The customer is solely responsible for backing up related data to avoid loss.

V. Disclaimer

(i) Except as expressly set forth hereby, H3C makes no warranty that is expressed implicitly or explicitly, including but not limited to warranties of merchantability, adaptability for a particular purpose, and warranties or obligations arising from a course of dealing, usage or trade practice.

(ii) H3C does not warrant that the software is error free or that the customer will be able to operate the software without problems or interruption.

VI. Compensation

In no event will H3C or its affiliates or suppliers be liable for data loss of the customer due to product failure or service interruption as well as consequential direct or indirect economic loss. The total compensation amount of H3C for the customer loss due to its liability, in any cases including those expressly stipulated in a contract, will not exceed the purchase price of the product paid by the customer.

H3C Technologies Co., Ltd. reserves the right of interpreting this warranty. H3C has the discretion to change any warranties, product performance and specifications without notice.
